Initial proposal
The proposed regulation was originally published in September 2016 and has since undergone rigorous public review consisting of formal hearings and workshops. The revised regulations reflect the feedback received during this period. The initial proposal moved to restrict many cases of pesticide use within a quarter mile of public K-12 schools and child day-care facilities from Monday through Friday between 6 am and 6 pm. It also called for California growers to provide annual notification about the pesticides expected to be used to facilities and the County Agricultural Commissioners (CAC).
Revised proposal
The revised proposal includes the following key revisions:
- Growers will not be required to provide notification 48 hours prior to application, however, they still have to provide annual notification of the pesticides expected to be applied within a quarter mile of these facilities
- The revision clarifies the definitions of certain terms, including “school site”, which not only includes school property, but also some parks used by schools on a regular basis
- The regulation is expected to go into effect January 1, 2018
